Terms of Service
Effective 11 October 2026
These Terms of Service (the “Terms”) govern your access to and use of Acteme, including the website, the studio, the API, the MCP server and the engine plugins (together, the “Service”). The Service is operated by Acteme (“we”, “us”). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of a company or other organisation, you confirm that you are authorised to bind it, and “you” refers to that organisation.
1. The Service
Acteme is a production tool for game developers and other creators. It lets you import scripts, assign voices to characters, direct individual lines, and generate, master and export synthetic speech. Speech and translations are generated by third-party machine learning models, currently provided by Google. We choose and may change the underlying models, and the voices, quality, languages and features available depend on those providers.
The Service changes over time. We may add, change or remove features, voices, models, languages, integrations and plan limits. If a change materially reduces what is included in a paid plan you are subscribed to, we will tell you before it applies to you, and you may cancel before your next renewal.
2. Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live if that is higher, to use the Service. You may not let any product directed at, or likely to be used by, people under 18 access the Service directly, for example by calling the API at runtime. Exported audio files may be used in such products. You may use the Service only from countries where the Service and its model providers are available, and not if you are located in, or are a person or entity targeted by, a country or list subject to sanctions or export restrictions.
You sign in with a Google account and must keep it secure. You are responsible for all activity under your account and under any API key you create. Keep API keys confidential and revoke a key promptly if you believe it has been exposed. Tell us at [email protected] if you suspect unauthorised use of your account.
3. Your content
“Your Content” means the scripts, character descriptions, direction and style notes, pronunciation entries and other material you submit to the Service. You keep all rights in Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit and modify Your Content, and to send it to our service providers, solely as needed to operate the Service for you, to keep it secure, and to comply with law. This licence ends when Your Content is deleted from the Service, subject to the retention described in our Privacy Policy.
You are responsible for Your Content and confirm that you have the rights needed to submit it and to have it processed as described in these Terms. We do not use Your Content to train machine learning models. Do not include sensitive personal information about real people in Your Content.
4. Output
“Output” means the audio files and translations the Service generates for you. As between you and us, and subject to these Terms, you own the Output, and we assign to you any rights we may have in it. We claim no royalties.
- Paid plans (Indie and Studio). Output generated while you are subscribed to a paid plan may be used for any lawful purpose, including in commercial games, trailers and marketing, and you may keep using it after your subscription ends.
- Prototype plan. Output generated on the free Prototype plan may be used for non-commercial purposes only, such as evaluation, prototypes, game jams and internal builds. To use a line commercially, generate it again while subscribed to a paid plan.
Voices in the Service, including studio voices and Acteme Specials, are made available to all customers on a non-exclusive basis. Other customers may generate similar or identical audio, and you may not claim exclusive rights in any voice or prevent others from using it. Because of the nature of machine learning, we do not warrant that Output is unique, that it is protected by copyright or similar rights in every jurisdiction, or that it does not resemble material owned by others. You are responsible for reviewing Output before you publish it.
5. Our rights
We and our licensors own all rights in the Service, including its software, website, studio, API, engine plugins, voice catalogue, documentation and design, and the Acteme name and logos. Apart from the rights expressly granted in these Terms, we grant you no rights in the Service. You may not copy, modify, decompile or reverse engineer the Service, or attempt to extract its source code, models or voice data, except to the extent the law allows despite this restriction.
We grant you a limited, non-exclusive, non-transferable licence to install the engine plugins in your projects, and to modify them for your own use, solely to access the Service. If you send us feedback or suggestions, we may use them without restriction or payment to you.
6. AI-generated audio
All audio produced by the Service is synthetic. The model provider may embed an imperceptible watermark that identifies the audio as AI-generated. You must not intentionally remove, alter or obscure any such watermark or other provenance information. You are responsible for any disclosure or attribution that the law or the platforms on which you distribute your product require for AI-generated content, including any applicable obligations under the EU Artificial Intelligence Act.
7. Acceptable use
You must not use the Service, or any Output, to:
- imitate, clone or impersonate the voice of a real person, or attempt to do so;
- create content that is intended or likely to mislead people into believing that a real person said or did something, including for fraud, scams, impersonation, harassment or political disinformation;
- present Output generated with a Acteme Special voice as a genuine recording of, or as endorsed by, the performer whose voice it is based on;
- create content that sexualises minors, promotes violence against people, harasses or threatens individuals, or is otherwise unlawful;
- act in breach of Google's Generative AI Prohibited Use Policy, which applies to all content generated through the Service;
- attempt to bypass, disable or work around the safety filters or content moderation of the Service or of its model providers;
- develop or train machine learning models that compete with the Service or with the models of its providers, or use the Service to extract or replicate those models;
- provide medical, mental health, legal or financial advice, or power clinical, emergency or other safety-critical systems where errors in generated speech could cause harm;
- resell or redistribute access to the Service or the API, or offer it as a standalone text-to-speech service;
- probe, scan or test the vulnerability of the Service, circumvent usage limits or credit controls, or interfere with its operation, other than through a coordinated disclosure to us.
We may review, block or remove content and suspend accounts that we reasonably believe break these rules, and we will cooperate with valid requests from law enforcement and rights holders.
8. Plans, credits and payment
Paid plans and credit packs are sold by Creem, which acts as our merchant of record and handles payment, invoicing and sales tax under its own terms of sale. Subscriptions renew automatically until cancelled. You can cancel at any time from the billing page, and the cancellation takes effect at the end of the current billing period.
- Each plan includes a monthly credit allowance that resets at the start of every billing period. Unused allowance does not carry over.
- Top-up credits remain valid for 12 months from purchase and are then forfeited.
- Credits are used only for audio that is newly generated for you. Renders that fail or are cancelled do not use credits.
- Credits have no cash value, cannot be transferred, and are forfeited when your account is closed. They are not refundable except as part of a refund of the purchase that granted them.
- Payments are non-refundable except as described in our Refund Policy and in sections 12 and 18. Cancelling a subscription does not refund the current billing period. If a payment is refunded or reversed, we remove the corresponding credits, and a refunded subscription ends immediately.
We will give you at least 30 days' notice by email before a price increase applies to your existing subscription. Nothing in these Terms limits any right you have as a consumer under mandatory law.
9. Storage and retention of audio
The Service is a production tool, not an archive. Rendered audio is deleted automatically once the retention period of your plan, as shown on the pricing page, ends, counted from when the audio was generated. Projects you archive are deleted permanently after the period described in our Privacy Policy unless restored. You are responsible for downloading and keeping copies of any audio you need.
10. API, MCP server and engine plugins
Access through API keys is subject to these Terms and to the rate and usage limits of your plan. Activity under a key counts as activity under your account. We may change or retire API endpoints and integrations, and will give reasonable notice of breaking changes to documented endpoints where we can.
11. Third-party services
The Service depends on third parties, including Google for sign-in, speech generation and translation, and Creem for payments. Their availability, models and terms may change, and we are not responsible for their acts or omissions.
12. Suspension and termination
You can stop using the Service at any time and delete your account from your account settings, after cancelling any active subscription. Deletion permanently removes your projects, audio and account data as described in the Privacy Policy, and cannot be undone.
We may suspend or terminate your access, with notice where reasonable, if you breach these Terms, if your use creates legal or security risk for us, our providers or others, or if we are required to by law or by a provider of the Service. We may suspend your access immediately and without prior notice if we reasonably believe you have breached section 7, if a payment fails or is charged back, or if your account or API keys appear to be compromised.
If we discontinue the Service for reasons other than your breach, we will give you reasonable notice, at least 30 days where we can, and refund any prepaid subscription fees for the unused period.
13. Disclaimer
The Service and all Output are provided “as is” and “as available”. Output is produced by machine learning models and may be inaccurate, mispronounced, mistranslated or offensive. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, that translations will be accurate, or that Output will meet your requirements.
14. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or for loss of profits, revenue, data or goodwill, arising out of or relating to these Terms or the Service. This does not limit your obligations under section 15, your liability for breach of section 7, or your obligation to pay amounts due.
To the fullest extent permitted by law, our total liability for all claims arising out of or relating to these Terms or the Service is limited to the amounts paid for the Service under your account in the 12 months before the event giving rise to the claim, or USD 50 if nothing was paid in that period.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, such as liability for death or personal injury caused by negligence, or for fraud.
15. Indemnity
If you use the Service for business purposes, you will defend and indemnify us against third-party claims, and related losses and reasonable costs, arising from Your Content, your use of Output, or your breach of section 7.
16. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will notify you by email or in the Service before it takes effect, and ask you to accept the updated Terms before you continue using the studio. If you do not agree to the changes, you may stop using the Service and delete your account.
17. Governing law and disputes
These Terms are governed by the laws of the country in which the operator of the Service is established, without regard to its conflict of laws rules, and disputes arising out of or relating to these Terms or the Service are subject to the jurisdiction of its courts. If you are a consumer, you also benefit from any mandatory provisions of the law of the country where you live, and you may bring proceedings in the courts of that country. Before starting proceedings, please contact us so that we can try to resolve the matter informally.
18. General
These Terms, together with the Privacy Policy and any plan details shown at purchase, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may transfer these Terms, together with your account, in connection with a merger, acquisition, reorganisation or sale of assets. We will notify you before any such transfer, and your rights under these Terms will not be reduced as a result.
We are not liable for delays or failures caused by events beyond our reasonable control, including outages, restrictions or changes at our providers, failures of networks or hosting, cyberattacks, natural disasters, war, labour disputes or government action. Where such an event prevents us from providing a paid plan for a substantial part of a billing period, you may cancel it and ask us to refund the affected period.
